When buying or selling real estate, funds are often held in escrow accounts in Florida—a secure bank account managed by a neutral third party such as a title company. This account protects all parties and ensures that money is only released once contract terms are met. Common examples include a buyer’s earnest money deposit, funds for post-closing repairs, or money reserved for taxes or trust disbursements.
Typically, escrow accounts in Florida do not earn interest for the buyer or seller because the funds are not yet legally theirs—they’re being held on behalf of the transaction. However, Florida law does allow interest-bearing escrow accounts under certain conditions.
When Can Escrow Funds Earn Interest?
Under Florida Administrative Rule 61J2-14.014, funds can be deposited into an interest-bearing account only if all parties provide written consent. The account must be held in an insured Florida-based depository such as a bank or credit union.
If interest is to be earned, the agreement must clearly state:
- Who will receive the interest (the buyer, seller, or broker).
- When and how the funds will be disbursed.
- That the title company or agent will provide an itemized statement showing the account balance, interest rate, and any accrued interest.
Any earned interest above $600 must be reported for tax purposes. Unless the agreement explicitly allows the title company to retain the interest, it must be credited to the designated recipient or applied toward closing costs.
Transparency and Protection
All escrow accounts must comply with Florida Statute 626.8473, which requires that funds be kept separate from a title company’s operating accounts.
