Can you close on a home without title insurance? The short answer is yes—but it’s not recommended.
In Florida, title insurance is not legally required for a real estate closing. However, that doesn’t mean it’s optional in practice. Most lenders will require a lender’s title insurance policy to protect their investment before they agree to fund your loan.
What Does Florida Law Require?
Florida law does not require buyers to purchase owner’s title insurance when closing on a home. This means that if you are paying cash, you can legally close on a property without any title insurance at all.
However, if you are obtaining a mortgage, your lender will require a lender’s title insurance policy to protect their financial interest in the property. This policy does not protect you as the homeowner—it only protects the lender.
Because of this, buyers are given the option to purchase an owner’s policy for their own protection—but it is ultimately their choice.
Why Skipping It Can Be Risky
An owner’s title insurance policy may be optional—but skipping it could leave you exposed to serious risks.
Title insurance protects you from issues that may not show up during a title search, such as:
- Unknown liens or unpaid taxes
- Errors in public records
- Forged or fraudulent documents
- Undisclosed heirs claiming ownership
Without title insurance, if a problem arises after closing, you could be responsible for legal fees—or even risk losing your property.
