Vacant land fraud? How can that be? Vacant land may seem like a straightforward real estate transaction, but in recent years it has become one of the fastest-growing targets for fraud. Across Florida—and especially in areas like Cape Coral and Fort Myers—scammers are using increasingly sophisticated tactics to impersonate property owners and divert sale proceeds before anyone realizes something is wrong.

One of the most common schemes we’re seeing is known as the Vacant Land Triangle. Understanding how it works can help protect buyers, sellers, and real estate professionals alike.

What Is the Vacant Land Triangle?

This vacant land fraud scam typically involves three separate locations, working together to create the appearance of a legitimate transaction:

  1. The Property (Location One)
  • Vacant, non-owner-occupied land
  • Often unencumbered (no mortgage or liens)
  • Owned by an out-of-state or absentee owner
  • The “seller” is unfamiliar with basic property details
  1. The Seller / Notary (Location Two)
  • Seller insists on remote notarization
  • Notary is located in a different city or state
  • Notary credentials are questionable or expired
  • Signatures don’t match or appear altered
  • Notary cannot be reached to confirm the signing
  1. The Funds (Location Three)
  • Push for a fast, all-cash closing
  • Wiring instructions direct funds to a different state—or country
  • Unusual or unfamiliar bank account details
  • Seller pressures the use of a specific wire transfer method
  • Initial wire may be rejected or “bounce back”
What Makes This Scam Work

Scammers exploit publicly available records to identify vacant land properties and absentee owners. They then impersonate the owner using fake identification, forged documents, and sometimes even sham notary credentials. By keeping all communication online and pushing for a quick closing, they limit opportunities for proper verification—until it’s too late.

Vacant land transactions are especially vulnerable because they are often viewed as low-risk and are frequently handled remotely.

Key Red Flags to Watch For

A transaction may be fraudulent if you notice:

  • An urgent request for a fast, cash-only closing—often at below-market pricing
  • A seller who refuses in-person or video communication, relying solely on email or text
  • A seller who provides or insists on using their own remote notary
  • A seller who lacks knowledge of basic property details such as tax status, improvements, or seawall information (a common issue with Cape Coral land parcels)

If more than one of these red flags appears, the risk increases significantly.
